Terms and Conditions

  1. 1. General aspects

ETERNAL BEAUTY S.R.L. with registered office in Salonta, 13 Iosif Vulcan str., jud. Bihor, registered at the Trade Register under no. J05/745/1996, with unique tax registration code RO8530622 (hereinafter referred to as "ETERNAL BEAUTY" or "We" or "Us") are a company operating on the retail market offering a wide range of professional products, namely perfumes, cosmetics, skin care products, equipment and other supplies. The products promoted and offered for sale by Eternal Beauty will be referred to throughout these Terms and Conditions as the "Products".

Our products are sold through our website https://etbprofessional.com/ and its subdomains ("Website").

This set of terms and conditions ("Terms and Conditions" or "T&Cs") sets out:

  1. a) the conditions under which a User may access and use the Website; and
  2. b) the contractual terms governing the relationship between Eternal and its Customers who purchase Products through the Website or as part of a telephone order.
  1. 2. Definitions

For the purposes of this T&C, except for terms defined elsewhere, the terms defined below shall have the following meaning:

Cont

the Customer's personal digital environment within the Website, to which the Customer has access through the use of the available authentication methods and the authentication data provided;

Content

  •  all information on the Website that can be viewed, viewed or otherwise accessed through the use of electronic equipment, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content;
  •  the content of any e-mail sent to Users or Customers by Eternal Beauty by electronic means and/or any other available means of communication;
  •  any information communicated to the User or the Customer by any means whatsoever by an employee of Eternal Beauty;
  •  information related to the Products and/or prices charged by Eternal Beauty in a given period;
  •  data relating to Eternal Beauty and/or the Website, or other proprietary data.

Customer

any User who places an Order via the Website or by phone, whatsapp, facebook messenger or Website Chat;

User

  •  any natural person aged 18 years or over, with full legal capacity,
  •  any representative of a legal person and/or PFA, registered and operating in accordance with the laws of Romania;

Order

an electronic document that intervenes as a form of communication between Eternal Beauty and the User whereby the User transmits to Eternal Beauty, via the Website, whatsapp, facebook messenger, site chat, his intention to purchase Products presented via the Website;

Telephone order

the request made by telephone by the Customer, by completing the necessary steps, in order to purchase Products, in accordance with the provisions of these Terms and Conditions, by Eternal Beauty.

Distance Contract

according to the law, is the contract concluded between Eternal Beauty and the Customer without the simultaneous physical presence of the two parties, with the exclusive use of one or more means of distance communication, up to and including the moment when the contract is concluded, and which is subject to information requirements of the Customer by Eternal Beauty before the effects of the concluded contract are produced;

Transaction

collection or reimbursement of an amount resulting from the sale of a Product by Eternal Beauty to the Customer, including by using the services of the payment processor agreed by Eternal Beauty, regardless of the method of delivery.

 

Review

a written assessment by the owner or recipient of a Good or Service, based on personal experience and their ability to make qualitative comments and say whether or not the Good or Service meets the specifications stated by the manufacturer

 

Rating

A way of expressing the degree of satisfaction of a User/Customer/Shopper with a product.The rating is expressed in the form of stars, each Good can receive a score from one star to five stars. This satisfaction rating will always be associated with the User/Customer/Customer's written review of a Good or Service.

 

Commercial Communications

any type of message sent (such as: email/SMS/phone/mobile push/webpush/etc.) containing general and thematic information, information on products similar or complementary to those you have purchased, information on Eternal Beauty or Eternal Group offers or promotions, information on Goods and Services added in the "Account/My Account" section or "Account/Favourites" section as well as other commercial communications such as market research and opinion polls.

 

 

GREEN STAMP DUTY

the amount expressed in lei, paid by the Seller to the company authorised to take over the collection, transport and recovery/recycling of waste electrical and electronic equipment, as provided for by the legislation in force.

 

 

 

  1. 3. Acceptance of Terms and Conditions and Rules of Sale 

By accessing and using the Website or otherwise accessing the Content, the User acknowledges and accepts the T&Cs and other policies relevant to the Website. For the proper use of the Website, the User is obliged to carefully read and comply with the T&Cs, as well as any other relevant Website policies, as they are displayed on the Website or as they will be notified to the User from time to time. .

The possibility to place an Order is only available to Users residing in Romania and who expressly indicate to Eternal Beauty a delivery address in Romania.

BY TICKING THE "I ACCEPT THE TERMS AND CONDITIONS" BOX THE USER EXPRESSLY AGREES TO BE BOUND BY ALL THE TERMS IN THIS SET OF TERMS AND CONDITIONS AND ANY OTHER SPECIFIC TERMS AND CONDITIONS APPLICABLE AT THE TIME OF AN ORDER.

AT THE SAME TIME, BY PLACING AN ORDER THROUGH THE WEBSITE OR BY CONTACTING US BY TELEPHONE, THE USER AGREES THAT THIS IMPLIES A DIRECT OBLIGATION TO PAY ETERNAL BEAUTY THE VALUE OF THE PRODUCTS ORDERED, AS WELL AS ANY ADDITIONAL CHARGES AS INDICATED. IF YOU DO NOT AGREE WITH THE PROVISIONS OF THESE TERMS AND CONDITIONS, IF ANY UPDATED PROVISIONS OF THEM PLEASE STOP USING THE WEBSITE ETERNAL.RO AND DO NOT ACCESS THIS SITE.

YOU CAN ALSO SEND A REQUEST TO DEACTIVATE YOUR ACCOUNT AND THEREFORE YOUR CUSTOMER STATUS TO OFFICE@ETERNAL.RO.

The deactivation of the Account following a request by the Customer shall not affect the rights and obligations arising between the parties up to the date of termination of the Customer's status, including in the context of Product Orders launched by a Customer via the Website.

Revocation of consent and deletion of the Account also has the effect of deleting the personal data associated with the Account, except for personal data whose processing is necessary after the deletion of the Account (see Privacy Policy for details).

  1. 4. Modification of Terms and Conditions

Eternal Beauty reserves the right to unilaterally change the T&Cs and any other relevant policies on the Website at any time. Continued use of the Website in any way, including by placing Product Orders, subsequent to the modification of the T&C constitutes the Customer's acceptance of the changes made. The amended T&Cs will apply to any Order/Transaction placed from the day of the amendment.

These Terms and Conditions were last updated on 24 August 2023.

  1. 5. Intellectual property law

The content is the exclusive property of Eternal Beauty and, where applicable, of its collaborators, to whom are reserved all rights obtained in this respect directly or indirectly (through licenses of use and/or publication).

The User or Customer is not permitted to copy, distribute, publish, transfer to third parties, modify and/or alter, use, reproduce, include any Content in any context other than as originally intended by Eternal Beauty, include any Content outside of the Website, remove any markings indicating Eternal Beauty's copyright in the Content, or participate in the transfer, sale, distribution of any materials made by reproducing, modifying or displaying the Content, without the express prior written consent of Eternal Beauty.

Any Content to which the User or Customer has and/or obtains access by any means whatsoever is subject to these Terms and Conditions, without any express or implied warranty made by Eternal Beauty with respect to that Content.

User or Customer may copy, transfer and/or use the Content only for personal and non-commercial purposes. Except as stated above, the Content may not be reproduced, modified and exploited for any commercial or non-commercial purpose.

No Content transmitted to a User or Customer, by any means of communication (electronic, telephonic, etc.) or acquired by them through accessing, viewing and/or viewing shall constitute a contractual obligation on the part of Eternal Beauty and/or its employees who facilitated the transfer of Content, if any, with respect to such Content.

The Content may be modified at any time by Eternal Beauty, and the images, design, text, graphics, logos, multimedia content, and other aspects of the Website and the Content may be changed at any time by Eternal Beauty as a suggested presentation.

Any use of the Content for purposes other than those expressly permitted by these T&Cs is prohibited. Requests to use the Content for purposes other than those expressly permitted by these T&Cs may be sent to the email address: office@eternal.ro.

Violation of this section shall entitle Eternal Beauty to take such legal action and measures including seeking such damages as may be appropriate against the unauthorized use of the Content, in order to repair potential material and image damage to us.

    1. 5.1. Order General rules

Access to place an Order through the Website is permitted to any User, regardless of whether they have opted to create an Account, who follows the process of an Online Order or Telephone Order (as indicated below) and accepts the provisions of the Terms and Conditions.

A User can have only one Account. It is forbidden to share an Account between several Users.

Eternal Beauty reserves the right to restrict or exclude User or Customer access to place an Order and to some of the accepted payment methods, or to delete or restrict the Account, within the limits of the law, if it considers that based on conduct or activity on the Website, access to place an Order and the existence of the Account could harm or prejudice Eternal Beauty or other Users/Customers in any way.

Eternal Beauty also reserves the right in its sole discretion, without any further notice or formality and without the need to explain its attitude, to suspend or terminate access to the Account, Website and/or Content in the event that it discovers irregularities and/or violations of any kind of the provisions of this chapter that result in the impairment or disruption in any way of our business.

    1. 5.2. Features of the Products offered for sale on the Website

Eternal Beauty may publish on the Website information about Products and/or promotions offered by Eternal Beauty or by any other third party with which Eternal Beauty has entered into partnership agreements, during a given period and subject to availability.

The Products offered for sale are accompanied by a description of them, allowing the User to become aware of the essential information on the characteristics of the Products before completing an Order.

All the information used to describe the Products available on the Website (static/dynamic images/multimedia presentations/etc.) does not represent a contractual obligation on the part of Eternal Beauty and is used for presentation purposes only. The Product images are for information purposes only, and therefore may differ from the final Product. It is also possible that Product specifications may be changed by partners or manufacturers without notice or that operating errors may occur.

Product information displayed on the Website is for informational purposes only and is not intended to replace the advice of specialists in any field.

In describing the Products, Eternal Beauty reserves the right to use other products (accessories, etc.) that may not be included in the cost of the Products described/displayed.

    1. 5.3. Availability of Products and Validity of Offers

Product offers and prices displayed on the Website are valid as long as they are visible on the Website and subject to stock availability. Offers available on the Website may differ from offers found on other Eternal Beauty sales channels, including but not limited to sales through sales agents or Call Centers.

If the price of the Product or some of its features have been erroneously displayed on the Website, we reserve the right to cancel the delivery of the respective Product and to notify the Customer as soon as possible about this situation, this situation not giving rise to any contractual obligation of Eternal Beauty.

Valid products and offers will be indicated on the Website by the "Add to cart" button next to them. The mere fact of adding Products to the basket does not constitute automatic validation of the order and reservation of the Products, and it is possible that between the moment of adding the Product to the basket and the moment of validation of the Order by the User, the Product/Products may become unavailable and their price may change, for which Eternal Beauty is not responsible.

If a Product becomes unavailable after it has been added to the cart, the User will be informed accordingly.

    1. 5.4. Order Online

The User can register Product Orders through the Website by adding the desired Product(s) to the shopping cart, following the instructions and steps displayed on the Website, and then validate the Order by making payment through one of the payment methods expressly indicated. An Order can also be registered via chat, whatsapp and facebook messenger available on the Website by following the instructions and steps communicated by the Eternal Beauty operator. For chat orders, the terms indicated in section 5.5. "Telephone Order" will apply accordingly.

Adding a product to the shopping cart without validating the Order does not automatically reserve it. Before validating the Order, the User will be provided with a summary of the information related to the Order (number of Products ordered, value of the Products, shipping cost, billing details, delivery method and delivery address selected).

The processing and dispatch of the placed Orders is carried out within the limits of available stock and after confirmation of the Order.

By completing the Order, the Customer agrees that all data provided by the Customer necessary for the purchase process is correct, complete and true at the time of placing the Order.

By completing the order, the Customer acknowledges that Eternal Beauty may contact the Customer, by any available means provided for in these T&C, in any situation where it is necessary to contact the Customer. Eternal Beauty may request additional information about the Order, including but not limited to the delivery address, if the information provided by the Customer is not sufficient to fulfill the Order. In this case the Order will be validated and the Remote Contract will be considered concluded only on the date of receipt of the requested new information.

Eternal Beauty may unilaterally terminate the Order made by the Customer, following a notice, sent by any means of communication, including telephone, addressed to the Customer, without any subsequent obligation of either party towards the other or without either party being able to claim damages from the other in the following cases:

      1. 1. non-acceptance by the Customer's card-issuing bank of the Transaction in the case of online payment;
      2. 2. invalidation of the Transaction by Eternal Beauty's approved payment processor in the case of online payment;
      3. 3. the data provided by the Customer on the Website are incomplete or incorrect;
      4. 4. the Customer's activity on the Website may and/or does cause damage of any kind, or in any way harm Eternal Beauty and/or its partners;
      5. 5. making more than two consecutive failed delivery attempts for the same order.

The Customer may cancel an Order placed, under the conditions set out in Article 9 of the Government Emergency Ordinance No. 34 of 2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and completion of certain regulatory acts.

In the event that the Customer withdraws within the legal withdrawal period from the Remote Contract, an Order placed with payment by bank card and in which the Customer's card issuing bank has transferred the amounts paid to Eternal Beauty's account, this amount will be returned by Eternal Beauty no later than 14 days from the date on which the latter became aware of the exercise of the right of withdrawal, using the same methods of payment as those used by the Customer for the initial transaction, unless the Customer has agreed to another method of payment, expressly indicated in writing by the Customer. As a result of a withdrawal from the concluded Remote Contract, the Customer will not be charged any fees following the refund, as these will be fully borne by Eternal Beauty.

If a Product ordered by the Customer, having previously made a payment by bank card, cannot be delivered by Eternal Beauty, Eternal Beauty will inform the Customer of this fact and will return the Products to the Customer's account within a maximum of 7 days, calculated from the date on which Eternal Beauty became aware of this fact or from the date on which the Customer expressly expressed his intention to withdraw from the Distance Contract as a result of this fact.

The customer has the right to cancel or modify the content of an Order paid by card, within a maximum of 24 hours after placing it. To this end, the Customer shall send Eternal Beauty a written request for cancellation or modification of the Order to office@eternal.ro.

If the Customer has made a change to the Order and the value of the new Order is less than the value of the Products originally ordered, Eternal Beauty will refund to the Customer's account the difference between the value of the original Order and the new Order within 14 days of Eternal Beauty becoming aware of this fact.

A cancelled Order cannot be reactivated and a new Order must be placed on the Website.

There is no lower or upper limit to the value of Orders that may be placed through the Website. However, if the Customer chooses to pay in cash the total amount of the Order, such Order value may not exceed the ceilings set forth in Law no. 70/2015 for the strengthening of financial discipline on cash collection and payment operations and for the amendment and completion of Government Emergency Ordinance no. 193/2002 on the introduction of modern payment systems or in any other applicable regulatory act governing such ceilings.

In certain situations Eternal Beauty may limit the number of pieces that can be purchased of a single item by a separate customer without having to give prior notice.

The history of orders made by Users, holders of an Account, can be consulted at any time on the Website under the heading "My Account" for a maximum period of 2 years from the current date.

    1. 5.5. Order by phone

The user can place telephone orders for Products by calling +40 730 277 868

daily, between 09:00 and 17:00, and performing the following steps:

      1. 1. Eternal Beauty will take the User's telephone order for Products;
      2. 2. To take the Order, the Eternal Beauty operator will ask the User for information about name, surname, telephone number, e-mail address, delivery address, and details of the desired Products;
      3. 3. After placing the Telephone Order, the User will receive an e-mail (to the e-mail address provided), sms or whatsapp with the payment link, as per item 5 below, including details of the Products ordered, the total cost of the Telephone Order, including delivery costs and collection/packaging costs, and a Telephone Order identification number;
      4. 4. The User will confirm to Eternal Beauty by: (a) phone or (b) email, (c) whatsapp (d) facebook messenger (e) site chat that: (i) the recorded phone order corresponds to the phone conversation and

(ii) agreement to pay the full cost of the Telephone Order;

      1. 5. Eternal Beauty will send the User by (a) SMS (b) e-mail, (c) whatsapp (d) facebook messenger (e) chat site a payment link for the agreed Order, mentioning the obligation to comply with the payment term indicated in point 7 below;
      2. 6. Payment of orders received by phone, SMS, whatsapp, facebook messenger, website chat is made by cash on delivery, bank transfer following a request for a proforma or by credit card in EUR, by accessing the payment link received by e-mail:
      3. 7. The User will access and make the payment within a maximum of 30 minutes after sending the payment link mentioned above, otherwise the Telephone Order will be cancelled;
      4. 8. Eternal Beauty will process the Order received by phone, SMS, whatsapp, facebook messenger, website chat immediately after confirmation of payment and will send the User an email confirming the telephone Order, including information on the Order summary, total Order cost, estimated delivery/collection schedule, and a copy of these T&Cs will be attached. The Remote Contract shall be deemed validly concluded at the time of confirmation by Eternal Beauty by sending the e-mail as per this article.

Products may be ordered by telephone with due observance of the other provisions of these T&C.

    1. 5.6. Contract and Finalisation

Eternal Beauty may place in the parcel sent to the Customer or send in electronic format, Email, SMS, Whatsapp, Facebook messenger, website chat, depending on the type of each Product, all the necessary documents proving the purchase of the Products by the Customer. In addition, Eternal Beauty may include in the package advertising materials to promote its own products or campaigns (or those of third party partners) as well as gifts to increase Customer loyalty.

Eternal Beauty will facilitate informing the Customer of the status of the Order.

Subject to the payment of the Order, the ownership of the Products shall be transferred at the moment of the signature by the Customer of the documents certifying the delivery of the Products, by any means practiced by the deliverer, and the Remote Contract shall be deemed to be executed between the parties, the Order being honoured.

    1. 6. Prices, payment methods and invoicing

The prices of the Products presented on the Website are in EUR and are inclusive of all taxes, excluding delivery cost or other costs applied by the shipper, including cash processing fee in case of cash on delivery orders, where applicable. For clarity, Prices include VAT, and any legal changes to the amount of this tax will be reflected in the price of the Products at the time of the entry into force of the VAT legislation.

In accordance with the law, the price of the Electronic Goods displayed on the Site includes the Green Stamp Duty. If the User/Purchaser requests details of the exact amount added to the price of the Goods, he/she shall contact the Eternal Beauty Customer Relations Department.

Price discounts will be highlighted on the Website by cutting off a line from the last price at which the Product was sold, and displaying the discount applied and the new price for the Product next to the Product. These prices are purely informative and have no legal value.

Prices and price reductions will be displayed in EUR currency. The reference currency for the calculation, payment and invoicing of the Products ordered will be the local currency lei (EUR). For the avoidance of doubt, in the case of online payments, the Customer is solely responsible for any additional costs incurred by the Customer, including but not limited to currency conversion fees applied by the bank issuing the Customer's card if the currency of issue differs from EUR.

The final price paid by the Customer consists of the purchase price of the Product plus the delivery cost and the cash processing fee in case of cash on delivery orders, if applicable.

Payment for orders placed on the Website can be made in the following ways:

    •  Cash on delivery, in which case an additional fee of EUR 5 is charged for cash processing by the courier.
    •  Payment by money order (bank transfer);
    •  Online payment by bank card.

Eternal Beauty uses Netopia Payments services for online transactions. The cards accepted for payment are those issued under the VISA (Classic and Electron) and MASTERCARD (including Maestro) brands. Payment is based on a secure online transaction processing system that offers confidentiality, security and simplicity in the purchase of products and services over the Internet. The processing of card data is done exclusively through the bank/payment processor. Eternal Beauty does not request or store any of your card details. Important to know - No fees are charged for bank card payments!"

Invoicing of the Products purchased is exclusively in EUR. If payment is made by bank card, Eternal Beauty will debit the Customer's current account with the amounts representing the value of the products ordered, after the Order confirmation has been sent to the Customer.

The tax invoice will be sent by e-mail to the e-mail address specified in your order on the day the parcel is dispatched. If you have not received the Invoice by e-mail, please contact us at office@eternal.ro

Fourteen (14) days after the purchase of a Good or Service, the Buyer will be required to enter a Review related to the purchased Good or Service. The request will be sent to the email address registered by the Buyer in the Account. In this way, the Buyer contributes to informing other potential Users/Customers/Buyers on the Site and is actively involved in the development of new Services and in detailing as fully as possible the characteristics of the Goods.

The Seller may assign and/or subcontract to a third party for Services related to the fulfilment of the Order, without the Customer's consent being required.

    1. 7. Delivery information

The delivery charge depends on the country of delivery and the weight of the parcel, as shown in the table below:

    • ○ Orders are delivered from the warehouse within 1-7 days for orders placed on the website from Monday to Friday, until 15:00, but delivery time may be extended in certain isolated situations (e.g. bad weather conditions, public holidays, unforeseen technical problems, etc.). We reserve the right to notify you if we encounter any of the above situations without any explicit obligation.

The details of delivery of the Products including but not limited to the time required for delivery do not constitute a contractual obligation on the part of Eternal Beauty, except for the obligation to deliver the ordered Products within the statutory period of 30 days from the date of conclusion of the Distant Contract.

    1. 8. Quality and Guarantee

Each Product purchased by a Customer, a natural person, benefits from a conformity guarantee according to the provisions of Law no. 296/2004 on the Consumer Code, as amended and supplemented, in conjunction with those of the Emergency Ordinance no. 140/2001 on the sale of products and associated guarantees, as amended and supplemented. Clear details of the characteristic features of each Product are provided on its presentation page.

The electronic/electrical products purchased through the Website benefit from the manufacturer's commercial guarantee for a specific period, according to each Product. Thus, each electronic/electrical Product delivered will be accompanied by the warranty certificate or declaration of conformity with the manufacturer's or importer's specifications.

In the event that the electronic/electronic Products fail and they benefit from the warranty period provided above, the Customer may complete the Service Form, available on the Website. Insofar as the repair of the Product under warranty is impossible, the Customer may choose to replace the Product, if available in stock, or to refund the price paid when purchasing the Product on the Website.

For a correct communication of the guarantee certificate related to the Goods in the Order, the Customer is obliged to update whenever necessary the data in his Account and to access the information and documents related to each Order, existing in the Account.

Through this way of communication, the Customer, by accessing his Account on the Site, will have a record of the warranty certificates issued by eMAG, being able to save and archive them at any time and in any way he wishes.

In the case of Goods sold and delivered by Eternal Beauty through its Marketplace partners, the Buyer will receive upon delivery for each Good covered by the warranty a warranty certificate with all the details of the service centre that provides repairs during the warranty period. The warranty of Goods purchased through Eternal Beauty from Marketplace partners is provided by the authorised service centre mentioned on the warranty certificate afferent to the Goods or by the Seller.

In the case of resealed Goods, the warranty certificate is issued by Eternal Beauty, and the warranty may cover a different period than the warranty period of the same new, sealed Goods. The warranty period is specified in the warranty certificate for each resealed Good. The conditions of use, handling and transport of a resealed Good are the same as for sealed products and benefit from the same services unless otherwise stated on the product page.

    Consumables such as knives, foils, clippers and razor housings, electrical cords and batteries for cordless electrical products are not covered by the warranty. These parts can only be exchanged/repaired for a fee.

    1. 9. Right of withdrawal

The Customer has the right to withdraw from the Distance Contract, i.e. to return a Product, within 14 calendar days, without giving any reason and without incurring any costs other than those of delivery, only in the condition received (unused, undelivered) Thus, according to the Government Emergency Ordinance no. 34 of 2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and completion of some normative acts, the period for returning a Product expires within 14 days from:

    •  the day on which the Customer or a third party indicated by the Customer takes physical possession of the Product;
    •  the day on which the Customer or a third party indicated by the Customer takes physical possession of the last Product - if the Customer orders in one order several Products, which will be delivered separately;
    •  the day on which the Customer or a third party indicated by the Customer takes physical possession of the last Product or part - in the case of delivery of a Product consisting of several lots or parts.

In addition to the legal right of return within 14 calendar days, Eternal Beauty offers the Customer the possibility to withdraw from the Remote Contract, i.e. to return a Product within 90 days from the date of purchase as long as it is returned in its original packaging intact and unused.

The following are exempted from the right of withdrawal from the Distance Contract:

    1. 1. Supply of Products made to Customer specifications or clearly customized;
    2. 2. Supply of Products that are likely to deteriorate or expire quickly;
    3. 3. Supply of sealed Products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the Customer (hair clippers and styling appliances, straightening boards, curling irons, hair dryers, cosmetic appliances);
    4. 4. Supply of Products which are, after delivery, according to their nature, inseparably mixed with other items;
    5. 5. Provision of digital content that is not delivered on a tangible medium, if the provision has begun with the express prior consent of the Customer and after the Customer has confirmed that he is aware that he will lose his right of withdrawal.

To register a return the customer has the possibility:

    1. 1. Call +40 730 277 868 or
    2. 2. Send an email to office@eternal.ro with the title Return.
    3. 3. To complete the Return Form available on the Website.

The cost of transport in case of return is borne by the Seller.

If, after receiving the returned Product in the warehouse, the return is not accepted by Eternal Beauty for reasons related to the non-fulfilment of the return conditions (used product, damaged packaging, etc.), the Customer is informed of the reasons for non-acceptance of the return and the Product is returned to the Customer.

If the Good is returned in a condition in which it can no longer be sold as new (open packaging, missing accessories, damaged Good), we reserve the right to charge a fee for returning the Good to its original condition, as appropriate, or to cover the difference in price resulting from the sale of the product as resealed or, at the Customer's request, we will reship the Good, the delivery costs being borne by the Customer.

If the Buyer exercises the right of withdrawal after having used the Goods to an extent exceeding the limit necessary to establish their nature, characteristics and functioning, the Buyer shall be liable for any diminution in the value of the Goods.

The accessories (user manuals, CDs, cables, etc.) in the box of the Good and its original packaging are an integral part of the Good. Therefore, we recommend that the Customer, when exercising his right of withdrawal from the contract, returns it in its original undamaged packaging, protected by wrapping with stretch plastic wrap or packed in a cardboard box (without labels stuck on it, without cuts, tears, etc.) and together with all its accessories.

Returned goods showing signs of wear and tear (stains, scratches, dents, cracks, dents, etc.) will be accepted only after they have been brought into conformity, involving the costs of sanitation, cosmetics, repair, replacement of any damaged parts and bringing them to a commercial form for sale as a Reconditioned / Resealed product. The final value is determined by the value of the parts to be replaced and the labour for reconditioning or the difference between the original value of the new product and the resale value of the used product.

Any diminution in the value of the Goods resulting from their handling other than that necessary to determine the nature, qualities and functioning of the Goods shall be the responsibility of the Customer. For clarity, from the total price of the returned Goods, the Seller shall retain an amount of money representing the diminution in value of the Goods in the proportion of 5%-50% of the original value of the Goods, as the case may be. The amount of the diminution fee will be communicated to the Customer upon receipt of the returned Goods.

 

    1. 10. Contact

For any information related to the Website or Orders, Users or Customers may submit a request by accessing the "Contact" section of the Website. Customers may also call the telephone number displayed on the Website from Monday to Friday between 9 a.m. and 5 p.m. Communication with the Seller may be carried out through direct interaction with the Seller, including through online support (Live Chat) or through the addresses mentioned in the "contact" section of the Website. The Seller is free to manage the information received without having to justify it.

Eternal Beauty reserves the right not to respond to requests of any nature, which are not related to the Products present on the Website or to a Distance Contract concluded with a Customer, received by any means of communication (electronic, telephone call, SMS, etc.).

We also kindly ask you to keep in mind that when you interact with Eternal Beauty representatives by phone, these conversations will be recorded in order to identify your needs, analyze the quality of services offered by Eternal Beauty and improve them.

You will be informed before the call starts and if you continue the call we will consider that we have your consent to record the call. If you do not agree to the recording, you can contact us through the other channels mentioned in the Contact section, available here, including through the Online Support chat functionality.

 

    1. 11. Limitation of liability

Eternal Beauty cannot be held liable in any way for a User or Customer using its Website Content other than as set forth in these Terms and Conditions.

If a User or Customer believes that any Content sent by any means by Eternal Beauty infringes intellectual property rights or any other rights, they may contact Eternal Beauty for details as per the contact details so that Eternal Beauty can make an informed decision.

Eternal Beauty is not responsible for the Content, quality or nature of other areas linked to from the Content, regardless of the nature of such links. The owners of those domains are solely responsible for the content of those domains.

Eternal Beauty shall not be liable for any use of the Website and/or Content transmitted to the User or Customer, by any means (electronic, telephone, etc.), via the Website, e-mail or an employee of Eternal Beauty, when such use of the Content may or does cause damage of any kind to the User or Customer and/or any third party involved in such transfer of Content.

Eternal Beauty makes no direct or indirect warranties that:

    •  The Website will be in accordance with the User's requirements;
    •  The website will function uninterrupted and error-free;
    •  Products obtained free of charge or for a fee through the Website will meet the Customer's expectations.

To the extent permitted by law, Eternal Beauty shall in no event be liable for any damages, whether direct or indirect, for any direct or indirect loss of profit (including, but not limited to: damages for loss of profit, business interruption or other pecuniary damages), suffered as a result of the use or interruption of use or lack of regularity of the information and services provided by the Website, even if Eternal Beauty has previously advised that the use of such information without expert advice may result in such damages.

    1. 12. Force majeure

Eternal Beauty and its affiliates shall not be held liable for any delays or errors in the Content provided by the Website resulting directly or indirectly from causes beyond Eternal Beauty's control. This disclaimer includes, but is not limited to: malfunctions of technical equipment owned and operated by Eternal Beauty, failure of internet connections to work, failure of telephone connections to work, computer viruses, unauthorized access to Eternal Beauty's systems, operating errors, strikes, etc.

Furthermore, except as expressly provided by law, neither party to a Remote Contract which has not been performed shall be liable for failure to perform on time and/or properly, in whole or in part, any of its obligations under the Contract if the failure to perform such obligation was caused by an event of force majeure. Force majeure is any external, unforeseeable, absolutely invincible and unavoidable event.

The party or the legal representative of the party claiming the aforesaid event shall immediately and fully inform the other party of its occurrence and take any measures at its disposal to limit the consequences of such event.

The party or the legal representative of the party claiming the above event shall be relieved of this obligation only if the event prevents it from being performed.

If within 15 days from the date of occurrence of the event, the event does not cease, each party shall have the right to notify the other party of the termination of the Distant Contract without either party being entitled to claim any further damages.

Advertising and Content provided by other parties

Portions of the Content may be provided by third parties with whom Eternal Beauty has contracts to provide Content. Also, advertising sections may be included within the Content where advertising messages from third parties will be displayed. Eternal Beauty is not responsible in any way for Content provided by third parties, whether or not it is advertising. Furthermore, Eternal Beauty is not responsible for the Content of pages linked to from the Website.

 

    1. 13. The law governing T&C

The rights and obligations of the parties imposed by these T&Cs and all legal effects produced by the T&Cs shall be interpreted and governed by the Romanian law in force. Any dispute arising under this agreement shall be brought before the competent courts of Romania for resolution.

    1. 14. REFERRALS AND COMPLAINTS. ALTERNATIVE DISPUTE RESOLUTION (SAL/SOL)

For any complaints or claims related to the Product and/or the Order, Users (including Customers) have the possibility to submit their complaint at any time through the contact form available on the Website. Eternal Beauty shall make every effort to respond to complaints or complaints within 30 calendar days from the date of receipt.

If Users (including Customers):

    •  do not receive a response within 30 calendar days; or
    •  receive a response beyond this deadline from Eternal Beauty; or
    •  are dissatisfied with the way the complaint/complaint was handled by Eternal Beauty;

have the right to use alternative dispute resolution (ADR/SOL) procedures.

ADR (Alternative Dispute Resolution) is an alternative mechanism to the court system, whereby consumers are offered the opportunity to resolve potential disputes when they have a problem with the purchase of a Product.

Having regard to the provisions of Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC, the User (including the Customer) has the possibility to opt for out-of-court settlement of any disputes, and by using the European online dispute resolution platform (SOL platform), a digital tool created by the European Commission to facilitate independent resolution, impartial, transparent, effective, rapid and fair out-of-court settlement of disputes concerning contractual obligations arising from online sales or service contracts between a consumer residing in the European Union and a trader established in the European Union. SAL and SOL do not represent two different mechanisms for the resolution of possible complaints/complaints, but they exist as a single mechanism, representing one and the same instrument with the same purpose, object and finality. The difference between ADR and ODR is represented by the access mode / initial format of the respective complaint/complaint, so that in the case of ADR the form of address of the consumer is a classic type, in writing (by e-mail, by post) whereas in the case of ODR, the consumer chooses to use the completion of an existing form on a digital platform, exclusively online.

15 .CONFIDENTIALITY

Eternal Beauty will keep confidential the information of any nature you provide. Disclosure of the information you provide will only be possible under the conditions mentioned in this Document.

No public statement, promotion, press release or any other form of disclosure to third parties shall be made by the Customer with respect to the Order/Contract without the prior written consent of the Seller.

By submitting information or materials through this site, you grant Seller unrestricted and irrevocable access to, and the right to use, reproduce, display, modify, transmit and distribute such materials or information. You also agree that Seller may freely use, for its own purposes, any such information, ideas, concepts, know-how or techniques that you submit to us through the Site. You will not be subject to any obligations concerning the confidentiality of the information sent, unless the legislation in force provides otherwise.

16 .COMMERCIAL COMMUNICATIONS

The Buyer/User/Customer may at any time change his/her option regarding the consent given to the Seller for Commercial Communications containing general and thematic information including information on offers or promotions as follows:

    • ● by accessing the unsubscribe link displayed in the Commercial Communications received from the Seller; or
    • ● by contacting the Seller.

By adding Goods or Services in the Account section:

"My Cart", the Seller will send the Buyer/User Commercial Communications regarding:

    •  - when changing the price of Goods or Services added in the "My Cart" section,
    •  - to recommendations of Goods or Services similar to those added in the "My Basket" section,
    •  - the existence of Goods or Services in the "My Cart" section, and
    •  - stock availability Goods or Services added in the "My Cart" section.

"Favourites", the Seller will send the Customer/User Commercial Communications regarding:

    •  - when changing the price of Goods or Services added in the "Favourites" section,
    •  - to recommendations of Goods or Services similar to those added in the "Favorites" section, and
    •  - stock availability or Services Goods added in the "Favorites" section.

Following the purchase of a Good or Service, the Seller will send the Customer/User Commercial Communications regarding:

    •  - Suggestions of Goods or Services recommended for use with the Good or Service purchased.

The Customer/User may unsubscribe at any time from the Commercial Communications mentioned above by accessing the unsubscribe link displayed in the commercial messages received from Eternal Beauty or by contacting Eternal Beauty to this effect.

We will also use your data to conduct market research and surveys to improve our Goods and Services offering and the shopping experience. The information obtained from such market research and opinion polls will not be used for advertising purposes but only for the purposes mentioned above. Your responses to market research and opinion polls will not be associated with your identity nor passed on to third parties nor published. You may object to the use of your data for market research and opinion survey purposes at any time by accessing the unsubscribe link displayed in the message or by contacting Eternal Beauty.

17. WRITING REVIEWS, COMMENTS, QUESTIONS AND ANSWERS

Users/Customers can write reviews in the "Reviews" section. The information entered can be both positive and negative, and will refer to the characteristics and use of a product or service.When registering a particular Review on the Site, Users/Customers grant the Seller a non-exclusive, perpetual, irrevocable, territorially unlimited license and give the Seller the right to use, reproduce, modify, adapt, publish, translate, distribute and display this content.

Each User/Customer, at the time of submitting a Review in the mentioned section, undertakes to respect the following rules:

-to refer only to features and/or how to use a particular product or service, avoiding information about aspects that may change (price or promotional offers) or information about how to carry out the Order;

-to use only Romanian. Words or expressions which, although not considered Romanian, are widely used in all media related to the field in question are also allowed

-to use appropriate, non-offensive language, without terms that may offend or harm any other User/Customer;

-to ensure that the information they enter is truthful, accurate, non-misleading and in accordance with applicable laws, including respecting the rights of other parties, copyright, trademark, licensing or other proprietary rights, publicity or privacy;

-to use this facility only to communicate on the Site without reference to other companies promoting the sale and purchase of products or services;

- not to provide or request, in any way and to any extent, personal data (contact details, delivery or home address information, telephone numbers, email addresses, first and/or last names, etc.) or any other information that may lead to the disclosure of such personal data;

- not to include information and/or details of URLs (links) from other commercial sites carrying out the same commercial activity as the Seller;

-not to attempt to defraud the services provided by the Seller or to submit Reviews/Comments containing material of an advertising nature;

- not to use the Review/Comment as a means of communication with the Seller, for this purpose the Seller's contact details registered on the Site will be used.

In addition to a critical realistic rating, when submitting a Review, the User/Customer will also add a Rating relevant to the related product or service. Reviews, together with their corresponding Ratings, will influence the overall Rating of the product or service, the number that appears in brackets next to their title. Thus, a Review accompanied by a high Rating leads to an increase in the overall Rating, and a Review accompanied by a low Rating leads to a decrease in the overall Rating.

Users/Customers who submit Reviews to which they attach photo or video files will respect the following rules:

-uploaded files will contain images and/or videos that relate to the product or service for which the review is being written, ensuring that the uploaded files respect copyright;

-uploaded files will not contain violence, adult content, lewd language or other content that offends a person/group on the basis of race or ethnic origin, religion, disability, gender, age, veteran status, sexual or political orientation;

-uploaded files will not contain information about other people;

-uploaded files will not contain URLs or watermarks to sites that are doing the same business as the Seller.

When a Review/Comment is flagged by a User/Customer as having inappropriate content, from a strictly subjective perspective, this content is carefully examined by the Seller to determine whether it violates the Site Terms and Conditions. The texts, photos or videos entered are removed from the Site only after examination by the Seller.

If the Seller finds repeated violations of the Terms and Conditions, the Seller reserves the right to suspend the User/Customer's ability to submit Reviews/Comments in the "Reviews" section.

Any complaints or claims related to the Goods and/or Service purchased by the Buyers shall not be subject to any Review, and the Buyers shall comply with the provisions of Chapter 15 above in order to resolve any such complaints/claims promptly and amicably.

18.INFORMATION ON WEEE

Waste electrical and electronic equipment (WEEE) may contain hazardous substances that have a negative impact on the environment and human health if not collected separately.

Taking into account the provisions of GEO 195/2005 - on environmental protection and GEO 5/2015 on waste electrical and electronic equipment, customers should consider the following:

    • ● Buyers are obliged not to dispose of waste electrical and electronic equipment (WEEE) as unsorted municipal waste and to collect such WEEE separately;
    • ● the collection of this waste (WEEE) will be carried out by the public WEEE collection service and by collection centres organised by authorised economic operators for the collection of WEEE;

This pictogram indicates that WEEE must not be mixed with household waste and that it is collected separately.
